copyright problems please help

Postby TomasJimenez » 15 Aug 2011, 19:00

Hola Amigos
Does anyone understand copyright?
A few days a go I uploaded to YouTube a movie of me playing Zapateado en Re by Sabicas. It is a live performance and my wife dances.
OK I have a notification from YouTube which says:

Matched third-party content.
So I click next to it for more information.
It tells me as follows:
Your video, Zapateado , may include content that is owned or administered by these entities:
• Entity: Music Publishing Rights Collecting Society Content Type: Musical Composition

What should I do?
No action is required on your part. Your video is still available worldwide. In some cases, ads may appear next to your video.
What can I do about my video's status?
Please note that the video's status can change if the policies chosen by the content owners change. You may want to check back periodically to see if you have new options available to you.

So from this I guess I understand that the Music Publishing Rights Collecting Society of the USA is not happy for me to upload this composition or may wish me to pay them to do so as they may ne the copyright owners.
I am surprised because many people have uploaded this same composition.
Does anyone have any ideas to share and should I just remove any videos which I play pieces by other guitarists?
Many thanks for any help you can give.
Saludos cordiales

I had that happen to me, on "Romanza d'Amor" of all things. Nothing to worry about, it is merely an acknowledgement that this is nominally a copyrighted selection. My own experience is that the copyright owners of "our kind of music" have no interest in pursuing royalty payments. Uploads of songs by, let's say, Lady Gaga or Garth Brooks would generate a different response. So long as you don't upload "Born This Way en ritmo de bulerias", you will be fine. (My ears hurt even contemplating something like that!!)

Over recent years similar notices have been received by many people who have uploaded videos containing any kind of music, regardless of whether the music is protected by a valid copyright or is in the public domain, and in the case of copyrighted music, regardless of whether any member of the Performance Rights Organisation actually owns the copyrights. It seems clear that software is being used to indiscriminately send those notices.

Their method of operation seems very similar to the action of the UK law firm ACS:Law that got themselves into serious legal trouble by sending thousands of letters to people claiming that they had downloaded illegal content. See: ACS:Law and ACS:Law, the law firm that has terrorized untold thousands of alleged file-sharers in the UK, has quit the anti-piracy business

This wiki article has some background information about Performance Rights Organisations.

Tomas, I would simply change the title. For example "Zapateado Tomas and Maria Jimenez." Give Sabicas credit in the write up. If you are playing then no problem and no reason to mention Sabicas in the title.

Hola Amigos

Thank you all for this information. It is most helpful.
I was and am surprised to have received the notification because the Internet is the place where so many musicians both amateur and professional upload their work which is often not their own compositions.
One idea I have heard is that someone else may have notified YouTube but I guess it would be difficult to know if that is the case.
Anyway from now on I will probably only upload my own compositions.
Thanks again for help.

I recently saw a video interview with one of the YouTube executives. They have a sophisticated search system which scans the text for matches, rather like Google's search engine. When it finds a match, it then activates a secondary program which scans the video for any similarity to the copyrighted item. This is the behind-the-scenes work which is being done in the time between your video finishing being uploaded and its being made available for viewing. Quite advanced concepts for a non-techie like me, but the way she described it, it seemed just all in a day's work.
